Terms and Conditions

Thank you for visiting the SongBird Survival website.

Please read these terms and conditions carefully before entering our competitions.

These terms and conditions govern the SongBird Survival Friends Not Food competitions 2022. The competition organisers are SongBird Survival. 

 

By accepting the Terms & Conditions of the competition and subsequently submitting your images, you have entered into an agreement with SongBird Survival. 

 

SongBird Survival, Friends Not Food Competition 1 – Kid's Competition: 

  1. Only entries made via the website form on https://www.songbird-survival.org.uk/fnfw3bsightings will be entered into the draw. 

  1. Entries must include 3 birds spotted and the 3-word area they were spotted in as well as contact email address. 

  1. Entries must arrive by the closing date of midnight on 15th August 2022. Any later entries may not be included in the draw. 

  1. All valid entries will be entered into a random draw to pick the winner after the closing date. 

  1. Winner will be notified by email and arrangements made to send the prize to a suitable address. 

 

SongBird Survival, Friends Not Food Competition 2 – Adult’s Competition: 

  1. Only entries made via the website form on https://www.songbird-survival.org.uk/fnfw3badultcompetition will be entered into the competition. 

  1. Entries must include a picture of your cat playing as well as contact email address. 

  1. Entries must arrive by the closing date of midnight on 15th August 2022. Any later entries may not be included in the draw. 

  1. All valid entries will be reviewed after the closing date and the favourite picture will be picked as the winner. 

  1. Winner will be notified by email and arrangements made to send the prize to a suitable address. 

 

 

The organisers reserve the right to modify these terms and conditions without notice. 

 

  1. By entering the competition, you warrant to SongBird Survival (SBS) that all information submitted by you regarding yourself and your competition entry is true and accurate and complete in every respect. SBS reserves the right to verify any information provided in connection with your entry. 

 

  1. The competition is open to persons who are resident in the United Kingdom, and also to persons who are resident outside of the United Kingdom provided that they are able to enter the competition without breaching any law or regulation of the jurisdiction in which they are resident. 

 

  1. If entrants are under the age of 18 they must have permission to enter from their parent or guardian. By submitting an entry for the competition, your parent/carer/guardian is deemed to have given such consent and to have agreed to the use of the entry as described in these terms and conditions. 

 

  1. SBS reserves the right in its absolute discretion to disqualify any entrant if it believes that an entrant has breached any of the Conditions, any applicable law (including without limitation copyright law) or has infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with the Conditions may lead to SBS disqualifying that person, without SBS being required to give any reason for such disqualification or granting any opportunity for challenge. 

 

  1. The competition is open to anyone except employees at SongBird Survival and those directly involved with the competition (including their families and relatives). 

 

Liability 

 

  1. SBS accepts no responsibility for entries lost, damaged or delayed whether due to transmission errors, website malfunction, computer error or otherwise.  

 

  1. Entrants agree to their submitted pictures appearing in the SBS supporter magazine, The Dawn Chorus, on the SBS website and social media of SBS. 

 

  1. Any contributions you transmit to us shall be considered non-confidential. By transmitting or posting a contribution to us you represent that you are fully entitled to do so; grant us a non-exclusive, perpetual, non-terminable, worldwide, sub-licencable and royalty-free licence to copy, modify, distribute, show in public and create derivative works from that material in any form and anywhere for all commercial or non-commercial purposes related to our work; and authorise us to adapt the relevant material in the course of doing so and so waive all moral rights you have in your contribution to the fullest extent permitted by law. 

 

  1. SBS will make every reasonable effort to ensure that name credits are given to any photograph published in any medium. 

 

  1. Any personal information relating to entrants will be used by SBS in accordance with data protection legislation in force in England. 

 

  1. All competition entrants unconditionally agree to the use of their name, and disclosure of their county of residence in connection with any Entry which is published in any form in any media. 

 

Governing law and jurisdiction 

 

These Conditions and any dispute or claim arising out of or in connection with them or their subject matter (including the Competition), validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law. 

 

The Courts of England shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with the Conditions or their subject matter (including non-contractual disputes or claims).
